PURCHASE TRANSACTION

In preparation for the closing of your purchase transaction, you will be required to do the following:
• Provide us with a copy of the Agreement of Purchase and Sale as well as all Notices of Fulfillment and/or Waivers and/or Amendments.

• Arrange mortgage financing, if required. Advise your lender to send all mortgage documents to our office at least three (3) weeks before the scheduled closing date, if possible.

• Contact your insurance broker for your fire insurance at least two (2) weeks before the scheduled closing date.

• Contact your Telephone and/or Cable company a few weeks before closing for setup.

• Contact other utilities to arrange your account. Even though we notify your municipal taxes, water, gas and hydro of the ownership change, we encourage you to contact them to supply any information they may need and to arrange special payment programs.

• Contact water heater company, if rental of water heater is being assumed, a few weeks before closing for setup. • Well and/or septic. If your new property has a well and/or septic system, you will need to provide us with a water potability certificate and/or septic certificate for your lender unless otherwise agreed upon.

• Advise us immediately if you will be unavailable to attend our offices on or before closing to execute closing documents.

• Book your movers no earlier than 12:00 pm on the day of closing 

Sale Transaction


In preparation for the closing of your sale transaction, you will be required to do the following:

• Call all utilities, cable and telephone to cancel and obtain final meter readings. You must provide them with your forwarding address for the final billing.

• Cancel your house insurance. Make sure it is cancelled effective the day following the closing date.

• Cancel any contract services, for example, alarm systems, newspapers, snow removal and/or other contract services.

• Inform us of any mortgages (this also includes secured lines of credit) that are registered on the property.

• Inform yourself of your mortgage payout figures. Inquire with your bank as to what penalties, administration fees,  discharge fees, etc., will be charged. Please be aware that on mortgage payouts, daily interest applies to the next business day as per your bank's instructions. If your mortgage is a secured line of credit, please do not use any funds from the line of credit near closing or in the event you do, please notify our office immediately.

• Advise us immediately if you will be unavailable to attend our office on or before closing to execute closing documents.

• Advise us immediately if you are a non-resident of Canada as defined by the Income Tax Act, as amended.

• Inform us of any potential problems such as court judgments on title, matrimonial separation, tax arrears, shortage of funds to pay mortgage(s), house problems, etc. 

Refinancing Transaction

In preparation for the closing of your refinance transaction, you will be required to do the following:

• Arrange mortgage refinancing. Advise your lender to send all mortgage documents to our office as early as possible before the scheduled closing date. You must make all arrangements directly with your lender concerning frequency and mode of payment. Remember to discuss with your lender any extra charges they might require (for e.g. CMHC, GE charges, administration fees, appraisal fees, commitment fees etc.).

• Advise us of any mortgages or secured lines of credit that you currently have registered on the property.

• Inform yourself of your mortgage payout figures. Inquire with your bank as to what penalties, administration fees, discharge fees, etc., will be charged. Please be aware that on mortgage payouts, daily interest applies to the next business day as per your banks instructions. • Provide us with a copy of existing Mortgage or Deed. (1st. page only)

• Provide us with a copy of your most recent tax bill marked paid and/or proof of payment.

• Contact your insurance broker for your fire insurance (this does not apply to condominiums). Please ensure that your insurance broker sends us a copy of the insurance binder before closing. The binder must indicated 1st Mortgage and 2nd Mortgage (if applicable) as the institution(s) from which you are borrowing (usually the Head Office not the local branch).

• Advise us immediately if you will be unavailable to attend our office on or before closing to execute the closing documents.

• Inform us of any potential problems such as court judgments on title, matrimonial separation, tax arrears, shortage of funds to pay mortgage(s), house problems, etc. 

Will and power of attorneys 


The Importance of Having a Will

Wealth planning is important for those of you who are concerned about your family’s future and want to ensure that lack of planning will not result in unnecessary hardship in the event of an unforeseen event, such as disability or premature death.
Regardless of your particular set of priorities, the only way in which you can ensure that your wishes will be carried out is by structuring a plan, usually with the assistance of an advisor.

The Importance of Having Power of Attorneys A Power of Attorney is possibly the most important document in your wealth plan. It allows you to appoint someone to act on your behalf (“attorney”) concerning either your property or your personal care in the event you are unable to make decisions as a result of illness or disability.

Your Will only takes effect when you die. Therefore, your personal representatives named in your Will do not have any authority over your affairs while you are still alive.

If you do not have any Power of Attorneys, members of your family will have to apply for a court order appointing them as your attorney, a process that can be time consuming and costly.

Like any important legal document, you should prepare and sign it while you are in good health and can take the time to make the right decisions. There are two types of Powers of Attorney.

A Continuing Power of Attorney for Property is limited to financial matters and is used in estate planning context. A Power of Attorney for Personal Care is limited to medical and personal care matters.  

Notary Public

Our services include notarization and commissioning of documents as well as drafting of affidavits, statutory declarations, invitation letters for visa applications, and more.

Please note that we do not provide legal advice on the documents being notarized. 

Certified True Copy 


A certified true copy is a photocopy of a primary document, which the lawyer certifies as being a true copy of the original. It is important to note that certifying a document as a true copy does not certify that the primary document is genuine, only that it is a true copy of the primary document.  

Children Travel Consent Letters

When travelling abroad with children, the federal government "strongly recommends" that they "carry a consent letter from every person with the legal right to make major decisions on their behalf, if that person is not accompanying the children on the trip.

The government also highlights that this travel letter should be notarized. Please note however that a consent letter does not guarantee the child's entry into a foreign state.
